1. Acceptance of these terms
Drivio (“Drivio”, “we”, “us” or “our”) is operated by [Drivio Technologies Limited], a company incorporated in the Federal Republic of Nigeria with registered office at Plot 2101 Cadastral Zone, Lugbe, Abuja.
These Terms of Service (the “Terms”) form a legally binding agreement between you and Drivio. By downloading, accessing or using the Drivio apps (the Drivio rider app and the Drivio Driver app), the Drivio website, or any related service (together, the “Platform”), you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Platform.
2. Definitions
- Rider — a person who uses the Platform to request, compare and book transportation.
- Driver — an independent transportation provider who uses the Platform to receive trip requests and offer rides at a price they set.
- Trip — a journey arranged through the Platform between a Rider and a Driver.
- Offer / Bid — a price a Driver proposes for a specific trip request.
- Fare — the amount payable by the Rider to the Driver for a Trip, as set by the Driver and accepted by the Rider.
- Drivio Pro — the subscription a Driver pays to access the marketplace (see section 8).
- Content — any information you submit to the Platform, including ratings, reviews, messages and photos.
3. The Drivio marketplace
Drivio operates a driver-priced marketplace. We provide technology that connects independent Drivers with Riders. Drivers set the price of each Trip themselves; Riders compare live Offers by price, estimated arrival time and rating, and choose the one they prefer.
Drivio is a technology platform, not a transportation carrier. We do not provide transportation services, and we do not employ Drivers. Drivers are independent contractors who are solely responsible for the Trips they perform, their vehicles, their conduct, and their compliance with all applicable laws, including holding the required driving licence, vehicle registration, road-worthiness certification, and insurance. Any contract for carriage is between the Rider and the Driver. Drivio is not a party to that contract and does not guarantee the quality, safety, timing or legality of any Trip.
We do not charge Drivers a commission on Fares. Instead, Drivers pay a flat Drivio Pro subscription and keep 100% of the Fares they earn.
4. Eligibility & your account
You must be at least 18 years old and able to form a binding contract to use Drivio. By using the Platform you represent that you meet these requirements and that the information you provide is true, accurate and current.
Registration
You register using your phone number and a password, and you verify your phone number with a one-time code. You may hold only one account per role unless we agree otherwise. You are responsible for keeping your password and device secure and for all activity that occurs under your account. Tell us immediately at contact@drivedrivio.com if you suspect unauthorised use.
One identity
Each phone number and email address may be associated with only one account. Providing false information, impersonating another person, or letting someone else use your account may lead to suspension.
5. Using Drivio as a rider
- Requesting a Trip. You set a pickup and drop-off, and Drivers nearby may respond with Offers. You are free to accept an Offer or decline them all.
- Choosing an Offer. When you accept an Offer, a Trip is formed directly between you and that Driver at the accepted Fare.
- Conduct. You agree to treat Drivers with respect, provide accurate pickup information, be ready at the agreed point, and not bring anything unlawful into the vehicle.
- Payment. You agree to pay the accepted Fare by the method you select (see section 7).
6. Driving with Drivio
Independent contractor
As a Driver you are an independent contractor. Nothing in these Terms creates an employment, agency, partnership or joint-venture relationship between you and Drivio. You decide when, where and whether to drive, and you are responsible for your own taxes and statutory obligations.
You set the price
You set the Fare for each Trip. Drivio may suggest a price based on your saved pricing defaults, but the final Offer is always yours. You keep 100% of the Fare — Drivio takes no per-trip commission.
Verification (KYC) & documents
Before you can accept Trips you must complete identity and vehicle verification, which may include your BVN and NIN, a selfie with liveness check, your driver’s licence, and vehicle documents (registration, insurance, road-worthiness and any locally required permits). You must keep these current and valid. We may suspend your access if documents expire or cannot be verified.
Standards of conduct
- Drive lawfully, safely and courteously.
- Maintain a roadworthy, clean and insured vehicle that matches the details on your account.
- Complete accepted Trips and do not discriminate against Riders.
- Do not solicit payment outside the agreed Fare or take Riders off-platform to avoid these Terms.
Earnings
Fares are paid to you by the Rider in cash at the end of each Trip. Drivio does not hold, process or transmit Fare money and is not a party to the cash payment between Rider and Driver.
7. Fares & payments
All Fares are paid in cash, directly from Rider to Driver, at the end of the Trip. Drivio does not process Fare payments and does not hold Rider funds. The only payments made through the Platform are Driver subscription payments (see section 8), which are processed by third-party payment processors (currently Paystack). Drivio does not store your full card details.
The Fare is agreed between Rider and Driver. Drivio does not add a per-trip service fee or commission to the Fare. Additional amounts lawfully required (for example government levies or tolls) remain your responsibility where applicable.
8. Drivio Pro driver subscription
To accept Trips, Drivers maintain an active Drivio Pro subscription. Drivio Pro is offered in tiers — currently Daily (₦2,500), Weekly (₦15,000) and Monthly (₦50,000). New Drivers receive a 90-day free trial after verification; you choose a paid tier at the end of the trial.
- Auto-renewal. Paid subscriptions renew automatically at the end of each period (24 hours, 7 days or 30 days from purchase) until you cancel.
- Switching tiers. You may change tier at any time; the change takes effect at your next renewal.
- Cancellation. You may cancel at any time. Access continues until the end of the period you have already paid for.
- No partial refunds. Except where required by law, subscription fees already paid are non-refundable for the unused part of a period.
- Lapsed subscription. If your subscription lapses, you keep your account but cannot receive new Trip requests until you renew.
Prices may change on reasonable prior notice.
9. Cancellations, no-shows & refunds
Either party may cancel before a Trip begins. Repeated or late cancellations, and no-shows, may affect your acceptance metrics and, in serious or repeated cases, your access to the Platform. Where a cancellation fee or no-show charge applies, it will be disclosed in the app before it is charged. Because Fares are paid in cash at the end of the Trip, no Fare refunds arise for cancelled Trips; refunds of subscription payments, when due, are handled through the original payment method.
10. Ratings, reviews & content
After a Trip, Riders and Drivers may rate and review each other. Ratings help keep the marketplace trustworthy. You agree that your ratings and reviews will be honest, lawful and free of abusive, defamatory or discriminatory content.
You retain ownership of Content you submit, but you grant Drivio a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that Content for the purpose of operating, improving and promoting the Platform. We may remove Content that breaches these Terms.
11. Safety
The Platform includes safety features such as trip sharing, an in-app safety/SOS option and trusted-contact alerts. These features are provided to help, but Drivio is not an emergency service. In an emergency, always contact the police or local emergency services directly. You are responsible for your own safety and for following lawful and sensible precautions.
12. Acceptable use
You agree not to:
- use the Platform for any unlawful, fraudulent or harmful purpose;
- harass, threaten, endanger or discriminate against any person;
- carry or transport anything illegal, or use a vehicle that does not meet legal requirements;
- manipulate prices, ratings, the matching system, referrals or promotions;
- attempt to bypass, disable, reverse-engineer, scrape or overload the Platform or its security;
- impersonate another person or misrepresent your identity, vehicle or documents.
13. Intellectual property
The Platform, including the Drivio name, logo, wordmark, designs, software and content (other than your Content), is owned by Drivio or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable licence to use the Platform for its intended purpose, subject to these Terms. You may not copy, modify, distribute or create derivative works from the Platform without our written permission.
14. Third-party services
The Platform relies on third-party services, including payment processors (Paystack, Flutterwave), mapping and routing (MapLibre and OpenFreeMap), SMS delivery, and cloud infrastructure. Your use of those services may be subject to their own terms, and we are not responsible for them. Links to third-party sites are provided for convenience and are not endorsements.
15. Disclaimers
To the fullest extent permitted by law, the Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free or secure, that Drivers or Riders will behave as expected, or that any Trip will be available, on time or satisfactory.
Because Drivers are independent contractors, Drivio is not responsible for the acts, omissions, conduct or vehicles of Drivers or Riders.
16. Limitation of liability
To the fullest extent permitted by applicable law, Drivio and its directors, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or related to your use of the Platform.
To the extent liability cannot be excluded, our total aggregate liability to you for any claim arising out of or related to the Platform is limited to the greater of (a) the total subscription fees you paid to Drivio in the three months before the event giving rise to the claim, or (b) [₦20,000].
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including your rights as a consumer under the Federal Competition and Consumer Protection Act, 2018 and liability for death or personal injury caused by negligence or for fraud.
17. Indemnification
You agree to indemnify and hold Drivio harmless from any claims, losses, liabilities and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the Platform, your Content, or — if you are a Driver — the Trips you provide and your failure to hold the licences, permits or insurance required by law.
18. Suspension & termination
You may stop using the Platform and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or applicable law, if your verification documents lapse, if we reasonably suspect fraud or unsafe behaviour, or if we are required to do so by law. Provisions that by their nature should survive termination (including sections 13, 15, 16, 17 and 19) will survive.
19. Governing law & dispute resolution
These Terms are governed by the laws of the Federal Republic of Nigeria. We would like to resolve any dispute quickly and informally — please contact us first at contact@drivedrivio.com and we will try to resolve it within 30 days.
If we cannot, the dispute will be referred to arbitration in [Lagos], Nigeria, conducted by a single arbitrator in accordance with the Arbitration and Mediation Act, 2023; the language of the arbitration will be English. Either party may still seek urgent interim relief from, and consumer claims may still be brought before, the competent courts of Nigeria.
20. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will give reasonable notice (for example, in the app or by updating the date at the top of this page). Your continued use of the Platform after changes take effect means you accept the updated Terms.
21. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Drivio about the Platform.
- Severability. If any provision is held unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may give you notices through the app, by SMS, or by email to the address on your account.
